			<content:encoded><![CDATA[<p>In today&#8217;s world of social networks, many litigators are unwise to leave these mines of data out of their discovery plans. People routinely place a lot of information online.  All of this information can be great for use in building case themes and gaining visuals to build your defenses.</p>
<p>You cannot &#8220;friend&#8221; the other party under the current rules of professional conduct. However, you should be able to obtain information through a set of interrogatories regarding what social networks he uses. You would also want access to the passwords. </p>
<p>Several courts have already allowed for the discovery of such information. I believe you will find the social networks to be a treasure trove of information. You will probably be surprised at how many individuals have waived their attorney-client privilege through such media.</p>
